This Privacy Policy explains how we collect, use, disclose, and protect your personal data when you use the FOMO mobile application (“App” or “Service”). It also outlines your privacy rights and how Portuguese and European laws safeguard them.

Interpretation and Definitions

Definitions

Account: A unique profile created by you to access our Service.
Affiliate: Any entity that controls, is controlled by, or is under common control with our Company.
Application: “FOMO,” the software program owned and provided by Expansive Verity, LDA.
Company: Referred to as “We,” “Us,” or “Our,” meaning Expansive Verity, LDA.
Country: Portugal.
Device: Any electronic device (e.g., smartphone, tablet, or computer) that can access our Service.

Location Data: The user’s real-time location used to provide nearby places in the HotSpots feed (not stored).
Post Location Data: The location that a user manually selects when making a post (stored but not directly linked to a user outside the post itself).
You: The individual accessing or using our Service, or the company or entity on whose behalf they are acting.

Collecting and Using Your Personal Data

Types of Data Collected

Personal Data

When using our Service, we may collect the following personal data:

Name and surname;
Email address;
Phone number;
Profile photo;
Age;
Any additional details you voluntarily provide when using the Service.

User Content

When you create posts or share content within the App, we collect:

Text and captions that you include in your posts;
Images or photos that you choose to upload;
The location you select for the post (this is stored and linked to your post).

Location Data

Real-Time Location (Not Stored): We access your device’s GPS coordinates while you use the App to show you nearby HotSpots and Sponsored Deals.
Session-Only Use: We do not persist any location data beyond the current App session; once you close the App, your live coordinates are discarded.
Post Location Data: When you manually tag a location in a post, that place is stored (but not linked to you outside of your post).
Sponsored-Deals Targeting: We may use aggregated, non-identifiable location data to rank or filter Sponsored Deals by proximity. No personal identifiers are shared for ad placement.

Usage Data

We may automatically collect certain technical and interaction data, including:

User interactions within the App (e.g., actions performed, features used);
Device ID (managed by AWS Cognito for authentication).

We do not collect IP addresses, device types, operating systems, or time spent on specific pages.

Use of Your Personal Data

We process your personal data for the following purposes:

Providing and maintaining the Service – ensuring the app functions correctly.
Managing your account – authenticating access and enabling account features.
Processing and displaying user content – ensuring that posts, images, and other submitted content are stored and presented correctly.
Providing location-based services – showing relevant nearby places in the HotSpots feed without storing your real-time location.
Communicating with you – sending updates, security notifications, or important information.
Improving our Service – analyzing usage trends and feedback to enhance functionality.
Ensuring security and preventing fraud – detecting and preventing unauthorized access or misuse.
Complying with legal obligations – fulfilling legal and regulatory requirements.

Sharing Your Personal Data

We do not sell or rent your personal data. However, we may share your data under the following circumstances:

With Service Providers – to assist us in operating the App (e.g., AWS Cognito for authentication).
With business partners – if necessary to provide additional services, under strict confidentiality.
For legal reasons – when required to comply with Portuguese or EU laws, or in response to legal requests.
In case of business transfers – if our company undergoes a merger, acquisition, or sale of assets.
With your consent – when you explicitly authorize sharing your information for a specific purpose.

⚠ User Content Visibility: Content (e.g., posts and images) that you voluntarily submit may be visible to other users of the App as per the App’s settings and features.

Retention and Transfer of Your Data

We store your personal data only for as long as necessary to fulfill the purposes outlined in this policy, unless a longer retention period is required by law.

Account data: Retained until you delete your account or request removal.
User Content: Retained as long as your account is active or until you manually delete the content.
Usage data: Retained for shorter periods unless required for security, troubleshooting, or service improvements.

We may store or process data outside Portugal or the EEA but only under adequacy or standard contractual clauses.

Deleting Your Data

You may request the deletion of your personal data at any time by:

Managing your Account settings within the App; or

Security of Your Personal Data

Encryption of sensitive information;

⚠ However, no system is 100% secure, and we cannot guarantee absolute protection against cyber threats.

Age Restrictions

Our Service is only intended for users aged 18 and above. If you are under 18, you are not permitted to use the App.

We do not knowingly collect personal data from individuals under 18. If you believe an underage person has provided us with data, please contact engineering@fomoapp.org, and we will take appropriate action.
